Handsome Technician Sexually Harassed Behind his back at Winchester Non-Profit

SEXUAL HARASSMENT OF MALE AT WINCHESTER NON-PROFIT

     A Winchester non-profit has hired unprofessional and unqualified hacks who spent (or possibly still spend) COMPANY TIME on Facebook and Match.com rather than do the job they were hired to do.

    For legal reasons the names of the alleged perpetrators and the victims are not being published at this time.

    A good-looking fellow who allegedly has a girlfriend is needed to make repairs at a facility in Winchester, a professional who has proved to be polite, efficient and very necessary for the operation of the 501c3 non-profit.

    Two of the employees made sexually-charged remarks about the individual, claiming that the fellow (the technician) had a crush on one of the employees with bragging about what the employee could "get out of " the man for Christmas.

    WITH SEXUAL HARASSMENT SIGNS POSTED AT THE HOSTILE ATMOSPHERE, the victim - most likely - has no idea that he is being perceived as a sexual object that the allegedly heterosexual harasser claimed he could "have" at any time. 

    Any women on the board of the directors of the entity should be horrified by this kind of sexually-charged talk by employees.  Because all you have to do is reverse the situation and wonder if a fired employee, a woman, was the victim of "shop talk" over her tattoos or whatever at the hostile environment where seniors, children and people from all walks of life are supposed to be able to freely come and go without being demeaned by whisper campaigns and inappropriate sexual talk.

     That two staffers would imply that a technician has a "crush" on a staffer and giggle behind his back in front of a member or members that the staffer should come up with a big gift to get from the fellow for Christmas, the Beatles "Rock Band"  was expensive back in the day and they were giggling like adolescents because they alleged the outside worker was in love with one of the staffers.

   If they wanted to engage in juvenile behavior, why be so open about it that a member had to hear their loud and obnoxious discussions of a sexual nature - not only objectifying the fellow - but demeaning him that they felt he was drooling over the employee.

     501c3's have a board of directors which, shockingly, the Executive Director of claimed recently, at an annual meeting, that he felt should be compared to other non-profits in Winchester.    News flash to Executive Director - you don't find a hostile atmosphere at other non-profits in Winchester where a now ex-staffer brags a vitally important technician is "in love" with him and that the staffer could sexually surrender himself to the man and get all sorts of expensive items for Christmas if "only" the staffer were gay.

    The staffer said that.  That he would have better luck if he were gay and all the things he believed the technician would buy for him.

    So members who pay a membership fee have to hear this garbage on a daily basis?

     They even had a nickname for the employee's "office" where they said they could engage in this kind of "shop talk" in front of 14, 15 and 16 year old kids who were members of the station as well.

    This is just one of many dirty, filthy incidents where paid employees did not do their job, refused to work, and spent the day and evenings in highly sexualized talk about both women and men.   One member of the Winchester school committee had a vulgar term for testicles applied to the end of his name by one of the buffoons while the other buffoon allegedly broke an expensive piece of equipment (the staffer actually told this witness that he had dropped and cracked the item which I will not describe ...not when a picture's worth a thousand words and the board of directors knows exactly what I'm talking about here*) while, allegedly, the executive director covered for him and allegedly lied to the board of directors that the expensive piece of equipment had failed to work on its own.

Members of the community were deprived of the equipment, which this witness needed on a weekly basis, because some unqualified hack got the job because he was roommates with another staffer.   Members are saddled with an individual who has no passion for the 501c3 and is only there to get a paycheck, much like the sloppy executive director who has a million excuses, tons of rhetoric and lip service, but who is in way over his head and coddled by members of the board of directors who have worn out their welcome, refuse to leave, and refuse to hear legitimate complaints about the dirty, filthy "shop talk" and sexually abusive tone that violates the law, violates the posted signs about workplace harassment, and are protected under the wing of a malicious woman who cares about her own rights, not the rights of unsuspecting members who sign up, pay money, and walk into the lion's den, or perhaps it is the den of the lioness.

     Reporting this to you takes great courage because one of the buffoons on the board of directors will write a certified letter and say making the report that they failed to act on public is the "creation of a hostile atmosphere."

    Got it, unsuspecting victims?   If you report the hostile atmosphere supported, enabled and facilitated by the negligent board of directors, they will turn on you and slash your name with their vicious attack, calling YOU the person who has created the "hostile atmosphere" when you are only the messenger.

    They kill the messenger at the Winchester non-profit.    Don't you wish to God they had a prosecutor or attorney on the board of directors with the spine to clean the mess up and put public safety first?

    Martha Coakley, where are you in our time of need? 

    Just ask Yubin, Molly, Erin and the girls what they would think about being used as objects of sexual conquest that the stud-in-his-own-mind staffer (who always complained openly he couldn't find a date) would snicker about to young high school teens...those teens told in no uncertain terms how many times the employee had sexual intercourse with them (the women noted above by their first names.)

    How demeaning to women!  How ugly for the polite and professional technician.   How vulgar of the board of directors to coddle the perpetrator and his accomplice.   The Winchester Police should seize the computers and hard drives and note how many times the staff were on Facebook and Match.com and seize the personal computer of the staffer before he wrecks the hard drive and throws it into the Atlantic ocean.

The following day, on Nov. 2, 2011, the Board filed paperwork with the Secretary of State's office in order to access the nonprofit’s bank account.  Upon accessing the bank account on November 2, the Board treasurer secured the bank records, examined them, and called Board members to review them with her immediately.  The Board then contacted an accounting firm and informed the Medford Police Department about suspected embezzlement.

A Safe Environment for Members

Non-profits are obligated to provide a safe environment for members, one that allows for free expression without rumors, innuendo and smear tactics aimed at members in good standing who work hard to benefit the community.

When an organization praises an individual as the member with the best productions that year, and then allows unqualified individuals to bully and harass the person, perhaps out of jealousy, the organization has a solemn duty to protect the person they praised who faces limited participation because an alleged employee is angry that someone is gifted and has talent.

In Medford the city lawyer noted that a (now dissolving ) non-profit was acting as if it were in "Havana." Any board member not "getting with the program" of a group dubbed allegedly by one adviser to the board "the entrenched cronies" was smeared and humiliated.

One member - who left of his own volition - stood up for all citizens.  Now the Attorney General's office referenced in a written document, a response to a public records request - that "law enforcement" is involved.

The non-profit is dissolving after a victim went to the police with charges of racism.  

There were other allegations of gay bashing and harassment by board members.   That entity is still in the process of dissolving, but what does it say about a community when people are pressured into not being able to express themselves without the threat of retaliation, bullying or loss of privileges?

Public Access TV Accounting Records

We applaud Wakefield and Malden access TV stations for being forthright and having issued documents with the financial records.

We urge all non-profits to do the same.

If your non-profit doesn't release an annual report to the members and citizens and make it available, kindly ask them why.

There is currently an investigation of a non-profit in Massachusetts that allegedly is "dissolving." The information they gave the city appears to be lacking.   The AG's office claims that "law enforcement" is involved.

In Brown v. J. Kaz Inc., d/b/a Craftmatic of Pittsburgh, — F.3d —, 2009 WL 2903348 (C.A. 3 (Pa.) 2009), Plaintiff Kimberly Brown brought an action against Defendant Craftmatic, charging violations of Section 1981, Title VII of the Civil Rights Act of 1964 and the Pennsylvania Human Relations Act, alleging discrimination based upon her race, including claims of disparate treatment, hostile work environment and relation.

 The United States District Court for the Western District of Pennsylvania dismissed all claims, finding that Plaintiff was an independent contractor at the time of the alleged discrimination and retaliation, and was therefore not protected by those Acts. The Third Circuit, in this case of first impression, ruled that Plaintiff could bring a claim for discrimination under Section 1981 of the Civil Rights Act, finding that the protections there under extend beyond employees to independent contractors.

Term limits have been installed at WinCAM.  Looking at the Articles of
Organization on Secretary of State Galvin's Corporate Data Base it notes
that you have been on the board since the Corporation's inception,
November 11, 2000.   Since your term has expired and we members
did not vote for it to be renewed, please tell this member in good standing when you are stepping down, now that term limits have been installed.

Staying onboard, voting for your own "term limits" when you have been on a publicly funded non-profit for 14 years, is not term limits.

When Deval Patrick stepped down Charlie Baker began his transition
team.  It is stunning that Allen Ayden has been on for 14 years with
Melodie Wing on for ten years.  

The problems at Medford Community Cablevision, Inc. became scarier for the members when the Board of Directors was dubbed the "entrenched cronies"
and the hostilities - false accusations on Dr. William Wood and his wife,
bullying Pat Fiorello and his wife (both dead; at least Pat's death hastened by frivolous litigation against him by a member of the board and the station manager...sound familiar?)

WinCAM's hostile attacks on members, not seeing Marcia Brown at the meeting last nigh and the other members I listed on a previous e mail,
along with Lydia, Dan Houlihan, Susan Guild, John Shawcross, Jeff Dearman, Robert Gotham, James Ravenscroft III - the turnover is much, much too great for David Gauthier, Exec Director, to say with a straight face there's 23 or 26 percent more members...AFTER they disposed of non-residents ...possibly
six or seven members, and there are people who wanted to join who never
got a call back in August.

Having paid a membership and to hear vague numbers is downright deceptive. Some may consider it dishonest.

The now defunct TV3 Medford had a Vice President who lives right near
Attorney General Martha Coakley.  Along with cussing filthy words at people at the City Council that individual did exactly what David Gauthier did :

We have 130 percent new members, we have 300 percent more programming,
all foolish rhetoric that ended up in the corporation forced to shutter thanks to
the Issuing Authority, Mayor McGlynn, being held accountable when McGlynn
had phony meetings at pizza parlors so his interaction with TV3 never got on the public record.

I filed Public Records Requests and the City Solicitor couldn't give me any
documents from the TV3/Mayor meetings at Bocelli's and Pizzeria Regina.

That's how business is conducted in Medford.  Does Winchester want to
go down this slippery slope?  News flash to Winchester, the failure of the Selectmen to show up at the Annual Meeting as McGlynn failed to keep an eye on Medford Community Cablevision, Inc. is the Selectmen being negligent

One member of WinCAM wrote on the condition of anonymity "I feel like they (Dave G and co) are just using the job to relax and have fun all day, not get serious about getting members. etc."

Couldn't agree more.   And how much programming is being generated by
the members who showed up last night compared to the members who are no longer creating content at WinCAM?

My show has not taped a live show since May, over six months have elapsed and the board of directors cannot connect to Verizon and Comcast for a live feed?  This happened somewhere else too...this happened when MCC TV3 Medford moved to Riverside Ave with no connectivity.

This is not fair. We are just seeking fairness.

The four new members of the board should take over; six more new faces need to be on the board, Mr. Shindelman, Mr. Pongratz, Mr. Ayden and Ms. Wing need to step down as it has become in the eyes of this member a serious conflict of interest.

"My board moves too slow" Melodie Wing said to me.  Melodie, Frank Pilleri also controlled his board and considered it his. The minute you say something like that, which you said to me Attorney Wing, is when you are no longer on the slippery slope.  You've already slipped and a decade means you have shaped WinCAM as your own personal sandbox, just as Frank Pilleri did in Medford.

The Public Charities Division of the AG's office is CC'd.  They recently informed me via public records request that "law enforcement" is now involved in the Medford Community Cablevision, Inc. fiasco.

WinCAM has treated this member and other members with hostility. False accusations, erased programming, bullying...just like TV3 Medford.

It is unacceptable and the Selectmen have an OBLIGATION to the Community to fix it.   I will invest a lot of time and energy into this problem until the Town of Winchester has a fully functional access station that serves the community and not the whims of entrenched board members and a rookie Executive Director,
so help me God.
