Executive Director Warns Member about Filing Complaints and that there will be retaliation for doing so

If you want to be friendly with the staff, you’ll need to stop tattling on them at every turn.

So if a teacher allegedly is sexually harassing his students about the women he alleges he slept with,
and you report the wrongful conduct,
or if the staffer allegedly tells adults that an "Asian" woman had a vagina like a "dime slot"
and you report him,
YOU are the problem at David Gauthier's Club House

Reporting Sexual

Harassment is not

"Tattling"

But reporting alleged inappropriate sex talk by a

29 year old in a teaching / authority position

could get you harassed, retaliated against

and abused at Winchester Community Access

and Media.

Any women out there think that while you are

editing you need to hear some jerk gurgling

about some alleged sexual experience and that

the woman he called "Asian" was like a "dime

slot" when he allegedly slipped into her?

You think that's funny?  Or is it degrading?

And why did we need to hear it?

News flash:  THE STAFFER MADE THE

COMMENT AFTER A COMPLAINT HAD

BEEN FILED ON HIM!

BECAUSE ATTORNEY MELODIE A. WING

IS NOT A 'STICKLER' FOR THE RULES,

AND BECAUSE WING VIOLATED HER OWN

POLICIES DEMANDING QUICK AND

FAIR RESOLUTIONS, THE WRONGFUL

CONDUCT WENT ON, AND THE COMPLAINANT

WAS HARASSED, HIS SHOW SABOTAGED,

AND HE WAS LIED TO REPEATEDLY BY

THE EXECUTIVE DIRECTOR, WHICH I

CAN PROVE VIA HIS E MAILS WITH

FALSE ALLEGATIONS THAT THE E.D.

HAD TO LATER RESCIND.

THERE ARE OVER 23,000 NON-PROFITS IN THE COMMONWEALTH -it is very hard for the government to keep a watchful eye on the cronies who entrench themselves at corporations like Winchester Community Access and Media or Medford Community Cablevision, Inc.

However, with public records requests and complaint letters you can push the visibility of these rogue non-profits to the top of the pile.

YOU can make a difference and get justice for the victims of harassment and for the alleged abuse of cable TV subscriber monies.

in SEPTEMBER of 2014, DAVID GAUTHIER
SENT AN E MAIL TO THIS AUTHOR NOTING THAT I AM A MEMBER IN GOOD STANDING.

ON OR ABOUT MAY OF 2012 WINCAM'S  BOARD OF DIRECTORS WAS NOTIFIED OF WRONGFUL CONDUCT BY GAUTHIER AND HIS STAFF

DO THE MATH

I view Gauthier's May 2012 e mail to be a threat and coercion - I am in touch with MULTIPLE lawyers, government oversight and local law enforcement about Gauthier's conduct and the conduct of his staff

 http://www.mass.gov/ago/consumer-resources/your-rights/civil-rights/civil-rights-complaint.html

Recognizing a Civil Rights Violation

There are various state and federal laws that protect your rights to access education, employment, housing, financial services, healthcare, transportation, voting, and marriage, as well as your free speech and privacy rights, among others.
For example, if you have been the victim of threats, intimidation or coercion based upon your race, color, national origin, religion, age, ancestry, gender, gender identity, sexual orientation or disability, or because you engaged in a protected activity (for example, the right to vote, or the right to obtain an education, or the right to freely associate), your civil rights under the Massachusetts Civil Rights Act may have been violated.

GAUTHIER, OUT OF CONTROL, DRUNK WITH POWER, AND WOEFULLY UNQUALIFIED AND OUT OF HIS DEPTH, REFUSED TO SEND ACCOUNTING TO A MEMBER WHO ASKED FOR IT...AND THEN LATER ATTEMPTED TO CHARGE FOR THOSE MATERIALS!!!

AFTER GAUTHIER WAS CALLED OUT ON IT.

WHAT IS GAUTHIER AFRAID OF BY DENYING A MEMBER-IN-GOOD-STANDING THE ACCOUNTING?

INTERPRETING DAVID GAUTHIER'S
WRONGFUL CONDUCT FOR THE
WINCHESTER COMMUNITY

if staffers belittle a technician, making gay slurs about the fellow behind his back...

if a staffer calls a member of the Winchester School Committee a vulgar name attaching a crude word for testicles to the end of the man's name

If a staffer keeps using the term "ball sack" in front of the young adults at the high school...

If a staffer uses the WinCAM equipment for his own show, and gets members to produce his show for him (abusing his authority; if you say "no" there could be retaliation)

If a president of a station accepts an award for Producer of the Year but the students don't have the opportunity that year because the queen of Wayne's World needs to put the award under her pillow...

then...why have rules and regulations?

WINCAM COMPLAINT POLICY THAT THEY NEVER ADHERE TO:

  4. If WinCAM determines that unlawful harassment has occurred, it will take effective remedial action in accordance with the circumstances and will inform you of the action taken. Any employee that WinCAM determines to have engaged in unlawful harassment will be subject to disciplinary action up to and including dismissal. Any volunteer so engaged will have WinCAM privileges suspended or terminated.

Harassment Complaint Procedure:

1. If you believe you have been unlawfully harassed, report the incident immediately and according to the following procedure so that the complaint can be resolved quickly and fairly.

2. When possible, confront the harasser and request him/her to stop. The harasser may not know that his/her behavior is offensive and may stop it once informed that it is not welcomed. If, however, you do not feel comfortable confronting the harasser or if the behavior continues after you requested the harasser to stop, then follow the procedure discussed in the paragraph immediately below.

MASS GENERAL LAWS THAT

DAVID GAUTHIER IS ALLERGIC TO
AND WILL RETALIATE AGAINST YOU
IF YOU REPORT HIS STAFF FOR
BREAKING THOSE LAWS

The WinCAM policies and procedures manual notes that complaints will be resolved “QUICKLY AND FAIRLY, AS TOWN HALL WAS ADVISED ON SEPTEMBER 26, 2014

Pursuant to Mass General Law Chapter 151B  Section 3A (d)

An employer’s compliance with the notice requirements of this section shall not, in and of itself, protect the employer from liability for sexual harassment of any current or former employee or applicant.

(ii) (ii) a statement that it is unlawful to retaliate against an employee for filing a complaint of sexual harassment or for cooperating in an investigation of a complaint for sexual harassment;

"You're FIRED"

http://www.blueavocado.org/content/firing-executive-director

Boards of directors tend to fall into one extreme or another when it comes to dissatisfaction with the executive director. Some boards let their dissatisfaction simmer for years without resolution. Other boards are too hasty and fire an executive at the drop of a hat or, more often, abruptly conclude a long period of silent dissatisfaction with a sudden termination. Sometimes just knowing more about how boards fire their EDs can help you relax into working more proactively with yours.

Sometimes it's necessary for a board to fire the executive director. In instances of embezzlement or unethical behavior, the need to terminate is clear to everyone. More often it’s a little fuzzier -- board members may get indications over time that the ED is either not doing (his or) her job or causing problems for the organization, but when to fire is not clear cut. So when and how do you do it?
